On September 1, the U.S. Centers for Disease Control and Prevention (CDC) ordered a halt to certain evictions only under specific circu
mstances through December 31, 2020. Although the order has been reported by media as an eviction moratorium, it is NOT really a moratorium. Only some evictions are impacted and residents MUST meet certain criteria and serve a declaration to property management or to the court in order to be protected.
If a resident does serve that declaration and you file an eviction for nonpayment of rent or continue one in progress, severe criminal and civil penalties can be imposed. In addition to the CDC order, Florida's executive order on evictions, which is set to expire on October 1, further complicates matters.
